Service: California Cleanup Fund

The State of California has a Leaking Underground Storage Tank Cleanup Fund (the Fund) that pays up to $1,500,000 for assessing and cleaning the soils and groundwater that are impacted by petroleum hydrocarbons from leaking underground storage tanks. The Fund has a deductible of $5,000 to $10,000.

The Fund is only available to qualified firms and individuals that can adequately document their case. TRG offers assistance and guidance in applying to the Fund and seeking reimbursement. After the application process, it may take several months to determine eligibility for the Fund and to be assigned a claim number. Small business owners are the Fund's priority and TRG's specialty.

When TRG performs assessment and remediation work for clients in the Clean-Up Fund, TRG's billings are prepared to conform to the acceptable standards of the Fund, including supporting documentation and subcontractor mark-ups. As an added convenience, TRG promptly prepares Cleanup Fund reimbursement claims at no charge to our clients.

This project is ongoing and funded by the Emergency, Abandoned, and Recalcitrant (EAR) Account which is administered by the Cleanup Fund. TRG has assessed the gasoline plumes in soil and groundwater (which extends off-site across a city street and beneath neighboring properties), installed soil vapor extraction and air sparge systems and begun active remediation. The core of the groundwater and soil plumes have been cleaned up. Semi-annual groundwater monitoring takes place through a network of 11 groundwater monitoring wells. An MTBE cut off plume remains to be cleaned up. The next phase of the project envisions the installation of six off-site ozone sparge wells to address the plume in the groundwater that has traveled off-site.

Additionally, to ensure an even greater impact on the overall project, TRG has coordinated efforts between the regulator on the case and the Clean-up Fund contact to lay out project plans and budgets on an annual basis thereby compressing the typical time-line of a project like this. Our client is kept up to date with every aspect of the project. Closure is expected from the Colorado River Basin Regional Water Quality Control Board within two years.

TRGs client had an open case at the San Diego Site Assessment/Mitigation Unit since 1991. When TRG was contracted as the environmental consultant of record in 2008, the case had already been transferred to the San Diego Regional Water Quality Control Board (SDRWQCB). We helped our client gain access to the Underground Storage Tank Cleanup Fund (USTCF) which reimbursed them for previous costs associated with assessment and source removal. TRG then completed the assessment of the contamination at the site and aggressively pursued case closure from the SDRWQCB arguing there was no need for active cleanup at the site.

In less than two and a half years, TRG was able to obtain funding and close a case that had lingered for well over a decade. All work performed by TRG was within USTCF cost guidelines and was fully reimbursed by the USTCF.

When The Reynolds Group was brought onto this project in the Echo Park neighborhood of Los Angeles, the soil and groundwater contamination had not been fully assessed. The site was, therefore, not eligible for closure consideration. We assisted our client with their Cleanup Fund application and secured funding for the project. Once funding was in place, the cost of all subsequent work was pre-approved by the Cleanup Fund in order to guarantee reimbursement of costs, and the contamination was fully assessed. Upon completion of the assessment, TRG performed a limited amount of soil remediation and demonstrated the groundwater plume was stable (not increasing or spreading in area). Results of soil vapor sampling and a Human Health Risk Analysis (HHRA) demonstrated there was no risk of detrimental effects to human health by way of gasoline vapor intrusion.
